It would probably be illegal under the federal constitution if the feds tried to do it for federal office because of the privileges and immunities clause of the 14th amendment. But they're interpreted that in a stupid way to only apply to federal privileges and immunities and not state ones so it'd have to be challenged under equal protection and that's a harder argument to make.
I think she should try to take it to the U.S. Supreme Court anyhow but I doubt she'd win.

Of course they will. This is the government, an entity run by morons. But that argument is dumb in my opinion. I would stick with the other stronger arguments.
