A Yuma County Superior Court judge touched off a furor last week when he disqualified Alejandrina Cabrera, 35, from running for city council in the town of San Luis over what he called a "large gap" between her English proficiency and that required to serve as a public official.

In a brief two-page ruling, the Arizona Supreme Court did not give a reason why it sided with the lower court judge, but said a written decision would follow "in due course."

"We're all burned out and disappointed. I'm really surprised. I figured they'd throw this thing out," John Minore, an attorney for Cabrera, told Reuters in an interview.


Interesting, should you have to speck fluent English to hold elected office?

This is an Arizona-specific law.

"The Arizona constitution states that: “[t]he ability to read, write, speak, and understand the English language sufficiently well to conduct the duties of the office without the aid of an interpreter, shall be a necessary qualification for all state officers and members of the state legislature” (Art. XX, sec. 8).

Another law adopted in 2006 (Arizona Revised Statutes 38-201.c.) states that: "[a] person who is unable to speak, write and read the English language is not eligible to hold a state, county, city, town or precinct office in the state, whether elective or appointive, and no certificate of election or commission shall issue to a person so disqualified.""

She was given a proficiency test and did very poorly, so she was disqualified.
