Service w/o screw-ups gets 10% from me ($2 minimum and about a $20 maximum)

I adjust up and down as necessary.

It an unspoken rule that you tip... the wait staff gets paid well below minimum wage for such said reasons

I would agree with the comment card/get a manager thing. They should know exactly why you weren't tipping well (or at all) so they can improve in the future (and know that it wasn't because "you're being cheap".

My husband and I went out recently to dinner and I asked for a couple substitutions in the meal I wanted due to my current medical dietary restrictions (I explained why when I was asking for the subs). Waitress was totally cool and wrote it all down, but came back a couple minutes later apologetically and said they wouldn't be able to do one of the subs because of a price point difference (her manager had told her no). I was very disappointed but I knew it wasn't her fault, so I said to go ahead with what she could do.

Couple minutes later the manager came to our table and said I would be receiving what I requested, he was very pleasant, etc. When he left I told my husband "I don't know what our waitress said or did but she is getting a GOOD tip!" Turns out that by changing my order to something else, she was able to get me the foods I wanted without the hassle of the substitutions (which wasn't obvious when I was looking at the menu) and it even saved us a couple bucks overall. She got a 50% tip when we left and I left her a note thanking her for the awesome job she did.

edit: also, I believe that if the tips they receive do not bring their overall pay up to minimum wage, the restaurant must make up the difference. So I would not feel guilty about not tipping, or tipping poorly, if it was due to poor service (though I would still want to be sure they knew why). They're going to get paid one way or another.

The logic is that you're poor and thus too cheap to pay people for doing a job.

Well, yes, but it might be unclear to the waitstaff exactly what the statement was. They could view it as "I obviously didn't give good service to that table" or they might think the statement was "I'm a sucky tipper/cheap bastard" (aka NON).

Gotta make sure they know, in no uncertain terms, why they got no tip or a poor tip.

See the thing is you can leave a full 15% tip so long as you fill out the card.
