How can Americans retake their freedoms and liberty?

We're at the mercy of the government right now. It doesn't matter if 99% of us oppose things like the Patriot Act and the most recent NDAA that Obama signed but said he'd never use against us, we're stuck with it like it or not.
What is the answer? Meet anything unconstitutional with lead poisoning? The way I see it, just asking nicely isn't going to cut it. Is there a process reserved for the people when the government quits listening? What do you do, start a petition and take it to Washington?
