Companies must make a REASONABLE exceptions for those who are afflicted. It works for H addicts on meth it will work for addicts smoking.
Dear Jury, I feel my companies new policy is hostile towards me and will cause me physical anguish as well as emotional stress due to a legal chemical dependency. I'm an adult and it's not illegal to be a smoker, in fact taxes on my habit pay for your roads and schools. If I can't smoke my body will react in a way that will distract me from my work and possibly threaten my employment. I believe this ruling will effectively cost smokers their jobs within this company and I have evidence that my company intended this for that purpose. In a time when employment is so critical do not let companies get away with such discriminating rulings intended to decrease their work force. I can produce evidence of my companies intentions regarding Government tax incentives for hiring replacements for the smokers they wouldn't need to fire. If other companies follow my companies example how long will it be until smokers across the nation can't afford the cigs that keep them from bashing your head in when you talk? How long until your taxes triple considering lost smoking taxes? I have a chemical dependency, which is LEGAL and well protected by my first and fourth amendment rights. My company is required by the DoJ, through the ADA, to make REASONABLE exceptions with regards to my habit.
