My girlfriend has some people renting her other house. They always pay the rent on time, are very quiet and polite and respectful. Last night the house was broken into, and the neighbor, a grizzled Korean war vet, scared off the intruder with a shotgun. Police were called, the couple returned home. The police search the place to make sure there are no intruders in the house. They find 60 Marijuana plants. The couple have a medical marijuana grow license, for 30 plants. The cops seize 30 plants, and can do nothing further. What would you do if this were your house?

P.S. I bought a 2010 blue Hyundai Elantra today.

Dear Dave,

I have ZERO advice to offer you but wow....30 plants being legal sounds like a lot. His electricity bill sounds expensive.

That is a difficult choice. Having renters that pay on time and take good care of a place are generally an asset.

But these people certainly went outside the law by having twice as many plants as they were entitled to. How would it affect her insurance coverage if the house caught fire because of all the plants and/or electricity being used? The insurance company could probably find an out if anything happened to the house because of illegal activities going on there.

The cops are going to probably be "keeping" an eye on the place now. How are the neighbors going to feel about that kind of scrutiny?

Im sure you realize it probably wasn't coincidence that their apartment was broken in to. Odds are its not going to be the last time.

Yes, I have considered that the insurance cost may be increased based on increased risk. Also it is clear someone they knew was the culprit. The neighbors aren't paying the mortgage, so I am not too worried if they are unhappy. Another consideration is cleaning when they vacate, there is a strong smell in the house.

do nothing....


p.s. the smell will dissipate with normal cleaning that is required by law when a tenant moves out(painting/carpet shampoo/etc) and opening the windows for a day

I'd probably kick them out. Good tenants are nice, but not so rare that it's worth tying your house up in the drug trade. Too many potential headaches...
