The right to ignore subpeonas under Executive Privilige has a long history in the United States.

As in George Washington invoked it. As did Jefferson.

It was upheld formally by SCOTUS in US v Nixon.

No. Not period. The judge has the authority to order him to appear but as the president he also has the perogative to ignore the subpoena in most cases.

I guess the best question here is not really about Obama but procedure.


If any of us were subpoena'd by a court in another state for the same reasons would we be compelled to appear?


If so then I'd say Obama should have to do so as well regardless of the merits of the case.


If not then there's nothing to worry about.

The plaintiff wanted the court to subpoena Obama. The judge asked the defendant's lawyer, in this case a local member of the DNC, for reasons why Obama shouldn't have to appear. The local guy submitted a weak brief and the judge said...this isn't enough. Last I heard, the judge was waiting for a more comprehensive argument. My understanding is that a simple...given his schedule, it would be a major imposition asking him to appear on a civil matter that his lawyers can easily handle...would be a sufficient argument, as it is in numerous civil trials.

amazing this case didnt get thrown out of court. Why waste taxpayer money on this stuff?
