This isn't about the fourth amendment.
Its about due process and innocent until proven guilty.
Cops are not there to sevrve death sentences on people suspected of doing anything which might be considered idiotic.
If this cop is so paranoid and scared for his life then he has no business carrying a gun or a badge.
He needs to be standing in front of a judge who will decide whether or not he rots in jail for the rest of his life.

Actually no, it isn't.
It's about not getting yourself killed by doing something stupid.
If the police are pointing guns at you and telling you to "freeze", "show me your hands" - then you'd better freeze and show them your hands. Doing anything else is likely to get you killed, and while you may put "Getting Killed because I Was Stupid" high on your list of priorities, I do not.
If the cops are wrong, if your rights are being trampled upon, deal with it in court. Trying to deal with it on the street is stupid, but then again that's pretty much all you bring to these topics so I guess I shouldn't really be surprised.
