Scanning through Kentucky's laws, there does not seem to be an authority clause in any of the language. There might be a state court ruling where that set that precedent, but as the law is written, there is no specific clause about Consent and authority figures like there are in other states.
Unless there's some federal law overwriting state law on this, I'm not so sure that statutory rape is a given for teachers like it would be in other states. What they are likely trying to determine is whether or not he was under the age of 16 when any of this happened. That would definitely be a violation of Kentucky law.
As far as the boy is concerned, I would actually be concerned about his future well being. Just because he's a boy doesn't mean he isn't a fragile ball of hormones just as lost as 16 year old girls are. The sheer nature of being involved with a much older person at that age coupled with being taken advantage of by someone in a position of power is going to saddle him with a tonnof baggage he's just too young to have. Pile national attention of top of it and this guys life is a train wreck just waiting to happen. Substance abuse problems will ultimately lead to domestic violence charges with whatever unlucky gal spits out kids for him after his 15 minutes of fame are over.

It's all too easy for teenagers to become completely emotionally dependent on their sex partners, regardless of gender. That's actually a good point for statutory rape laws applying here. Sure it's easy for us to sit here and say he must have had an amazing time in the sack with a cheerleader, but the cost could be awfully high emotionally, far too high to be worth a few go-arounds with said cheerleader.
On the other hand, he might not have given a ****. In which case he'll be ok.
