Sounds like they were probably trying to release crap, a year late no less, and Codemasters wouldn't let them and rightfully sued their arses off.
Not that I disagree with you, but that's how the ball bounces in this industry. This is not just an issue with games either, but with any major IT projects in general. If you expect people to invest loads of cash into your project, you better make sure you negotiate reasonable mile-stones with some buffers built in for inevitable blunders, or you deserve to get your arse sued when you grossly neglect the terms of your agreement.
It's not like anyone is suing anyone over missing a mile stone or two by a few days or even weeks, it's most likely many months and it's costing investors loads of cash, and often ends up making a game obsolete even before it's launched. It's also not like any investors expect to actually make money off suing someone they fell in disfavor with, but rather they're trying to recover whatever they can before that turns into a big fat ZERO. (The only ones making money either way, are of course the lawyers!

If you have a name like Blizzard or Bioware then you have the clout to negotiate and even re-negotiate milestones, but that's simply because in the end investors know they're going to get a quality product. (And because Blizzard/Bioware has the ability to say up front "It ships when it's ready! If you can't handle that, don't sign the bottom line!"

That's more then you can say for many other game dev shops pf the past (and surely some still out there), where no matter how much time & money was pumped into them, they still never produced a release-worthy product.
