Whenever you see capitalized words in a legal document (in this case, "Game Content"
, it means that the words have a special meaning which was defined earlier in the document. Therefore we can look earlier in the EUALA and find the definition of "Game Content." Here's the definition from EUALA 2.A:"
ou acknowledge and agree that Mythic is the sole and exclusive owner of the System, and that Mythic or its suppliers are the sole and exclusive owner(s) of all right, title and interest (including, without limitation, all intellectual property rights), code, programs, routines, subroutines, objects, files, data, characters (including all items, currency, objects and attributes comprising or associated with a character and an Account), and information uploaded to, downloaded from, and accessible through the System, including, without limitation, graphics, sound effects, music, animation-style video and text, some of which may be provided to Mythic under license from independent content providers (collectively, "Game Content"
."These programs don't modify those things.
If you disagree, would you please tell me which thing on that list is modified by these four programs?
As you make your choice, please note that this is a list of things that Mythic owns. Everything on that list is property. If a thing can't be owned -- if it can't be property -- it can't be on that list.
(And by the way, there's a second reason why this rule doesn't apply. These programs don't change game play. Game play means things that happen inside the game. But let's look at one issue at a time.)
