If you could help clear up a few things for me please.

5. MODIFICATIONS AND AMENDMENTS TO EUALA

The terms and conditions of this EUALA may be amended or modified from time to time by Mythic. The fact that the EUALA has been amended or modified shall be communicated to you at the time you log in to your Account. You will be asked to review the revised EUALA, and to indicate and confirm your acceptance by clicking "I ACCEPT," and "CONFIRMED" buttons in a dialogue box, as a condition of access to your Account. If you accept the revised EUALA, you will be granted access to your Account.

If the revision alters a material term, and you, in good faith, determine that the modification is adverse to you and unacceptable, then you shall have the right to terminate the agreement and close your Account, or to terminate the agreement and hold open your Account for a period of sixty (60) days to allow you a limited period within which to transfer your rights to your Account pursuant to Section 1(E) of the EUALA. You may exercise these rights by clicking the "I DECLINE" button. Upon clicking the "I DECLINE" button, you will then be prompted either to terminate the agreement and hold your Account open for a period of sixty (60) days to allow you to transfer your Account rights as set forth in Section 1(E); or to terminate the agreement and immediately close your account; then you will be prompted to confirm your choice. If you fail to confirm your acceptance of the revised EUALA, or if you fail to confirm your election to either hold open your Account or to close your Account when prompted to do so, you will be deemed to have exercised your right to terminate the contract and close your Account. In any event, if you fail or decline to accept the revisions in the manner specified above, your access to the System will be discontinued, and all rights to access the System and play the Game granted under this EUALA shall be terminated immediately. If you terminate the agreement because a revision is unacceptable to you, at your request, sent to Mythic via electronic mail, any prepaid access fees will be prorated as of the effective date of your termination, and any portion due to you will be refunded.


If you accidentally hit decline and cancel to reload the patcher with the intent to hit accept can you? Or is it too late?

Does this mean only banned users? Or anyone who formerly played Daoc but doesn't not have an active account atm?
Does this also include users who have never played before and you lend an account to them to encourage them to start their own accounts?


I'm not trying to be picky, it's just really confusing for us to figure out.

Hey it's a legal document, a contract. It was written by a lawyer. You're supposed to read it in a picky way.

I think Section 5 gives Mythic the right but not the obligation to accept your termination. Therefore, if you called EA customer service and explained that it was an accident, I think they could, if they wished, keep the account open. We can't learn from the EUALA whether they would do this.

This applies to anyone whose account has become inactive or closed for any reason. But this paragraph only describes that person's rights under a single agreement. Since Mythic allows people to have more than one account, I think we have to conclude that if you have a second account and it's still open, you would still have rights under that second agreement to play the game.

Under the EUALA you are never allowed to let anybody else use your account. It's in section 1A:

The EULA is created to cover themselves from all kinds of weird legal actions from players against the company. We are a sue first, ask questions later society.

I think most grown-ups understand that if the game was canceled, you have no right to sue because of your in-game items, time spent, or if your heart is broken and you can't go on living.

I don't know when DAOC will shut-down, but I know it can't go on forever.

Robbie spelled it out pretty clearly, the only real change to the Eula was the "We will no longer restore deleted toons".

I appreciate the kind words, but there isn't any change.


The current EUALA was first published in 2002, ten years ago, and it's exactly the same today as it was in that year. Since 2002, Mythic and Electronic Arts have never made a single change. Every word, every letter, every comma are exactly the same now as they were ten years ago.


(There was an earlier EUALA, in 2001, but that was a different document. If you compare the 2001 EUALA to the 2002 EUALA, you'll find many dozens of differences.)


I made this point earlier in this thread and DarkPCK replied that I should post screenshots. He was joking but you know what? Maybe I really better post some screenshots!


So let's look at some pictures. I just pulled my ten-year-old Shrouded Isles CD out of its dusty box, popped it in the DVD drive, and took a screen shot of its property page. That's on the left in the picture below. Then I downloaded a fresh install of DAOC from Mythic's server and allowed the patcher to place a brand new copy of today's EUALA on my hard disk. That's the picture on the right below.


As you can see from the circled items, the two EUALAs, ten years apart, are the exact same file. This file was last modified on November 5, 2002 at 4:08 in the afternoon and Mythic and Electronic Arts have never changed it a single time since.





But wait. Maybe it's just a coincidence. Maybe by accident the two EUALAs have the same size and same dates and same times, but the contents are different.


All right, let's get some more evidence. I just wrote a little program to calculate the CRCs of the two files' contents and compare them. In the picture below, you're seeing this program execute in a debugger. The program has just finished executing the code in the picture. The stuff in the red circle shows what the program figured out. If the two files are exactly the same, the variable called "bAreTheyTheSame" will be true. As you can see from the watch window (red circle), it's true. The files are identical.


Mythic and Electronic Arts have never changed the 2002 EUALA since that year. Not even a comma.





And once again, like I said earlier, if you don't trust this programmerish stuff, here's a link to the 2002 EUALA. You can read it side by side with the current EUALA and prove to your own satisfaction that they are the same.

It's not actually the Eula i meant to refer too, it's the new CoC. The jist of the change says "No longer will we restore deleted characters unless it's a bug".
