Just like a drunk driver usually intends to kill when he gets into an accident, right?
Please tell me you see the stupidity in your argument. Regardless of the kid's intent, he was stupid to run across the train tracks, just as a drunk driver is stupid to drink and operate a motor vehicle. Both result in the injuries of others. How is this any different? Because the kid was not drunk? Drunk-body-throwing charge?
Logic - utilize it.

The main difference I see is that when a drunk driver hurts someone it is during the commission of a crime. Drunk driving is illegal. Running across a railroad track isn't.

Yeah sucks for the kid, but imagine if the lady doesn't have health insurance right now? That would effectively bankrupt her.
Train kid did something stupid and it caused bodily harm to someone else. Derp?
