Microsoft has forced almost every Android manufacture into paying it licensing fees for every device with Android installed on it. Because Microsoft claims various technology in Android uses it's patents. Rather than fight Microsoft, the manufactures just folded and are paying Microsoft.

Surprisingly B&N however isn't playing ball. It's fighting it. And I think it's the only one that seems to be putting up a serious effort to thwart Microsoft's licensing fees.

B&N is alleging that this is more about Microsoft rerailing Android, than an actual concern about protecting some trivial patents. They also allege the fees are excessive. Despite allegedly only owning trivial bits of Android, Microsoft charges more for it's licensing fees, than it does for Windows Phone 7.

And now B&N is presenting prior art example of Microsoft patents in use before Microsoft patented them.

Indeed! I'll help contribute by continuing to be a member and buy books from there. I actually had a mix-up with an order for the book Inheritance and they sent me a 5 dollar gift certificate so with that plus the pre-order special I only paid 10 bucks for my book. Great company imo.

I'm sure companies are just rolling over and paying MS rather than fighting it because it has no teeth right?


Don't you think that if there was not significant evidence that there was some sort of infringement, these companies would fight it? I know I would if it was costing me profits.

Sadly it is the state of legal affairs these days. It is cheaper/easier for companies to settle than to fight so they settle. You see it all the time.

A lot that caved to Microsoft's license requests also sell other products using Windows. Have a feeling they felt it was in their best interest to just pay the money or suffer the consequences elsewhere.

B&N doesn't sell phones or computers, has no dependency on Microsoft, so apparently feels braver to fight them on this issue.

The patent system is so horrible, that pretty much everyone is probably violating someone else's patents. But I do think B&N is correct in the license fee seems like extortion. A license for Windows Phone 7 OS costs around $8 to $15, that is for the entire OS. And at the same time, Microsoft is asking Android manufactures to pay $5 to $15 for a tiny trivial bit of code in Android it claims to own. There are manufactures that are paying more to Microsoft for Android than Windows Phone 7.
