I think it's stupid to make it a crime to encrypt something but on the other hand it's also stupid to say you have a right to hide the files on your HDD from the police if they have a valid warrant to seize the HDD.

The Supreme Court still overrules the DOJ as far as I know and they've said that it's a violation of your first and fifth amendment rights to have to divulge your passwords.

I would think the company who does the encryption would have your PW and stuff stored somewhere - or at least be able to retrieve it - and that the government could force them to turn it over.

If the police enter your house on a warrant and you have a safe, are you required to open it for them?
I really don't know, but it would seem to defeat the purpose of a warrant if the answer is "No".

You aren't required to do shit other than let them take what they want or destroy it before they get there.
If they're at your door and you haven't prepared for the fact that they might actually come to your door for the shit you have on your hard drive then you're pretty much effed in the a anyway.
