Depends on levels to some extent.
There's actually code in place that makes any class that cons green or higher to a 50 appear as yellow con, so at 50 all you see is grey or yellow players, until they die.
As for the original question, I've played the game since beta, and no emote has been respected in anything other than a personal case by case basis, ever, to my knowledge. In fact a significant portion of the game population have always held that sort of thing as a somewhat grey area under the TOS.
