What if he shot back missed and hit your kid across the street
Whew, then THAT mistake would be rectified
The policy behind the law is prevent EXACTLY that from happening. And if a kid got shot he would be charged with a class B felony because he is directly responsible for the death of an innocent person.
Given the facts his charges are going to be dropped to a misdemeanor... probably get a fine/most of it suspended if he stays out of trouble for a few years. That is how it works.
But how else am I supposed to get an abortion in the 50th trimester!?

people should learn never to use a gun to give warning shot, just shot the !@#$ or don't bother with a gun at all.

You can tell me how it's reckless because I don't deem it as such. Breaking into someone's house is reckless.
Good thing no one gives a s--t what you deem, that's not how the law works.
The criminal being alive is testament to poor aim, not a lack of deadly force. Releasing that force with an intent other than to kill is reckless. Warning shot, negligent discharge, or crappy aim; he discharged a firearm in the direction of a living thing. If you're not willing to kill it, your finger shouldn't even be on the trigger.
No one but the e-vigilantes here would try to justify something as idiotic as a warning shot. He should get off with minimal punishment because the results were benign and his intentions were good not because you morons think he's justified...
