You don't fire warning shots. He's not a cop, he's not a cowboy. Shoot the man because your life and/or property (depending on state laws and personal moral) is in danger or don't pull the trigger.

If he wants to play gangster or vigilante then he can jump into the criminal category and stop making it difficult for responsible gun owners to keep their rights...
