That suit would be tossed instantly, as you would be suing the wrong party. You cannot sue the government for this lost data as the government has no responsibility of care for your data. MegaUpload does, so they're the ones you have to target.
The government is not deleting the data, nor are they asking that it be deleted. The MegaUpload hosting providers are the ones that might nuke the data for non-payment.
The only way customers get a case into court is to sue MegaUpload for the loss of the data. MegaUpload would have to then sue the government as it was they who froze the assets that resulted in the non-payment, but end-users themselves would have absolutely no case against the government.

Banana republics, rule by whimsy instead of ethical principled law. These are no different than the crown ruling by whimsy. They don't even care to bother themselves about the ramifications of their actions because like the crown you have to go to their kangaroo courts to beg them to reconsider their actions (often after the fact).
Who cares if millions of peons had a business contract, who cares if losses are incurred, the government laughs at you while it takes what it wants when it wants. It doesn't need any stinking due process, that is for lessor beings who have no government clout.
