Uh the whole point of the exchange is that no one took it all that seriously at the time. Which is true.


"It's unconstitutional!!!11" was pretty much the preserve of fringers like CNSNews until it actually got passed. It came up in the debates but not as anything approaching a central issue.

In order to prove the constitutionality was a central part of the debate you picked a time period starting with when the law was passed.

Making your arguments in a logical sequence doesn't mean you didn't care about the last argument from the very beginning. It just means you saved the argument for the time it made sense to make it.

I'm glad you agree RWNs mostly waited until the bill was already passed to bring up the constitutional angle rather than making that a central part of their opposition to it.

If the health and welfare of its citizens is not a compelling enough reason to believe congress has this power then the commerce clause should be challenged in about ten other laws. I don't see how this bill will be ruled unconstitutional. I don't even think it will be close.

There were discussions on many fronts, and the constitutionality of a "mandate to purchase and participate in a private market" was one of the earliest hot buttons for opponents of the bill. And even some supporters.



like mandatory auto insurance thats been legal for decades now.
