The only thing that should matter is whether or not a person can perform the functions of said job within the job description.

Once we started letting companies piss test their employees, this was bound to happen. They already allow them to test for nicotine and fire you if they find it, now no fat people, soon they will be giving everyone cholesterol tests monthly and if yours is too high in the bad stuff....out you go. You are driving up our insurance rates you bacon eating ingrate. We need your facebook password to check and see if you are in a gang or have friends who look like they do drugs.
Soon, they will require you to allow company representatives into your home at any time to insure you aren't doing anything that could "negatively impact the companies reputation", next step....24/7 real time monitoring. Gotta make sure the corporation (Hail the corporation) is protected. Don't like it, don't work here.
And of course we will get the chorus of "Just work someplace else, the "market" will take care of these things and if people really object, they will go out of business". Yeah, that really works when unemployment is running at 15% and every damn job is with a subsidiary of 20 or 30 major corporations...who all have the policy. Starve under a bridge or let us control every aspect of your life. The near term future of this effed up hell hole of a country.

I agree with most everything you said but this part is always loltastic to me because these policies almost never lower insurance rates...they just protect the insurance companies from liability (ie, protect insurers' profits).

That's what I was thinking. Some obese can get disability. You know someone will challenge it and probably win.
In Appeals Court maybe, but the Supreme Court won't vote it down. Although Scalia might throw in a surprise dissent judgment on this one...

It looks like the hospital is making the case that fat people cannot perform the required duties as fat employees are now bad for hospital patients.
I guess this could be true...but I would not give the employer the benefit of the doubt on this one.

I suspect you're right about the angle the hospital is going for, and also agree with you that I would not give the employer the benefit of the doubt here...
If we did give them the benefit of the doubt:
Should divorced attorneys be allowed to practice family law?
Should physicians' diets be monitored for absolute healthfulness? People might be shocked to find out how many physicians have REALLY crappy diets or bad habits like drinking too much or even smoking.
Bottom line: this is just another step down that slope and yet another precedent that will cease to be an exceptional case and soon become a standard...
