The powers are partially separated, not completely separated. The legislature, for example, can pass a law saying "The Supreme Court has no jurisdiction to hear cases about the health insurance mandate" and that would be that. Going down that road would be a bad idea for the country (and it's a power that's been historically used very very sparingly), definitely, but it's there as an option within the system. By the same token, it's an option for the judges on the Supreme Court to become incredibly partisan, disregarding the constitution and their own prior interpretations of it -- leaving the rest of us with little recourse. But it's a very bad idea if they go down that route.

That law would be overturned just like Obamacare for being unconstitutional. I won't even get into how many years of contract law would be violated by Obamacare forcing everyone into a contact against their will.

Mere technicality. The fine could simply be rewritten as an additional tax that's waived if you have health insurance.

I think its clear from Obama's recent remarks that he was the beneficiary of "social promotion" at Harvard law School. Obama clearly doesn't understand the power of the judiciary.

You do realize that 85% of legal scholars think the mandate is constitutional, right?
