Ok not sure on how to start this ,

Lets say i take pictures and sounds from AC to create something for my personal enjoyment , over here in Germany this would be perfectly legel.

Now say i want to give it away for free and supply a way to download it , free of any charges or fee's.

I have to ask Turbine for permission right ?


I already pm'd Frelorn about 2 weeks ago and asked for permisson, he read the pm but didn't bother to answer till today.


Btw this is for a theme or some Nokia Cellphones , it changes backrounds , sounds screensaver and sometime later mayby i will work on a set of new menu icon's.

If you make any profit on it, then no you can't. You must also apply a copyright notice on ALL material which relates to AC (check the notice at the bottom of my Website [came from IBN]).

Hmm guess that makes it far more complicated then.

I sure hope i dont have to put a copyright notice on every single picture wont be to bad to include it in a txt tough.

ELtank uses pictures and icons from the AC data, however, YOU made PROFIT from it and then

ran away with it when the bank took .80 cents from you when TURBINE made a billing mistake.

Actually im very glad he posted that off topic remark. He is exposing someone for the little child that he is. Not one person agrees with his reasoning on why his auth server was shut down. He is just being a big baby stomping his feet and honestly, I wouldnt trust any advice he gives you.

I not suprised that Frelorn did not respond. He is not the right person to contact for permission. You need to contact the lawyers in Turbine's legal department.


You might try reading the Terms of Service. There are two important statements in that huge document:


1) Turbine hereby grants you a personal, non-exclusive, non-transferable and non-assignable, limited license to use and display, for home, noncommercial and personal use only, one copy of any material that you are expressly authorized to download from this Turbine Site, such as content, audio or images which are made available for personal use by our fans or for press coverage (collectively the “Downloaded Content”); provided, however, that you must include or maintain all copyright and other notices contained or associated with such downloaded content.


2)You may not modify, alter or create any derivative works of any Downloaded Content.


My interpretation of statement 1 is that you must give credit to Turbine by including copyright information. You may not share it with anyone else.


Statement 2 is not as clear. From my own experience in the software industry you can not use Turbine's content as the base for anything else. You can not import the images into another graphic engine. It might be allowable to convert them into themes for your cellphone as long as you include a Turbine watermark or copyright. You would have to contact Turbine legal for this.

Well i guess i will keep it for me , i doubt there would have been much intrest anyway.

But he could have at least told me that he is the wrong to ask.

I have no clue about all this stuff and just wanted to do something creativ.
