No death penalty in VT... but jeez this case looks super easy... the lady called her ex telling them the snow plow people broke down... her little kid even said that mommy started crying and grabbed his neck... and her car was still running when police found the kid.
How would you say that it was not pre-meditated... that your car broke down... call someone to help... just get enraged when you see them strangle them out of the car... then your car magically starts again and throw the body in the back seat...

My guess on this: they said more charges could be coming. You can only hold someone for 72 hours without charging them. I suspect they will charge them with 1st degree murder, they just didn't want to take the chance and let them go. They still need to build their case for 1st degree murder but 2nd degree was a slam dunk.

Sure as hell does look like first degree. But I see the penalties for 1st and 2nd degree are the same, left up to the judge.
