If they strike down the mandate I don't see how the preexistings change doesn't kill healthcare pretty quickly.

The interesting thing at that point would be if the Supreme Court strikes the preexisting condition part of the law or if they leave that for Congress to do.
If they leave it for Congress, it could turn into a game of chicken.

The stated price for Obamacare is just a tiny fraction of the real cost. The individual mandate is a trick they use to cost shift about $4 trillion dollars. If they'd paid for the whole thing with a tax they would have had to admit the real price. If they'd done that they never would have passed it.

The federal government has mandated the purchase of private insurance before. In fact, the very first congress did it.
Not really sure why Verrilli failed to mention this.

THIS
As a constitutional lawyer Obama knew what he was doing and went to great lengths not to raises "taxes". Of course he wanted the whole thing passed in 2 weeks, ran over the opposition and is not surprised anyone disagrees with him.

Fairly awful showing by Verrilli regardless of the outcome. I expect him to be replaced either way as SG. He seemed completely lost at times during oral arguments, especially on Monday, like Mascara in a strip club or paulg in an economics class.
